ONLINE STORE TERMS OF SALE

The owner of the online store www.peachyswear.com is peachys oü (registry code 17194149), located at Lääne maakond, Haapsalu linn, Haapsalu linn, Kalda tn 55a, 90504Peachys OÜ is responsible of personal data, and Peachys OÜ forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

Validity of the Sales Agreement, Product, and Price Information

The terms of sale apply when purchasing goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. The price includes a fee for the delivery of the goods. All prices of the goods sold in the Online Store are in euros.

The delivery fee depends on the location of the buyer and the delivery method. The delivery fee is displayed to the buyer when placing the order.

Information about the goods is provided in the Online Store directly next to the goods.

Placing an Order

Here, the merchant must follow the specific purchasing procedure of their online store.

To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out and the appropriate delivery method for the products selected. Then, the amount to be paid is displayed on the screen, which can be paid securely through the following payment methods:

Remove these payment methods if the online store does not use them and add others if additional payment solutions are used.

Payments are mediated by Maksekeskus AS. Payment is made outside the Online Store in a secure environment – in the secure environment of the respective bank when paying by bank link and in the secure environment of Maksekeskus AS when paying by credit card. The seller does not have access to the customer's bank and credit card details. The contract is concluded upon receipt of the amount due to the Online Store's account.

The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

If it is not possible to deliver the ordered goods due to the goods being out of stock or for any other reason, the buyer will be notified at the earliest opportunity and the paid money (including delivery costs) will be refunded immediately, but no later than 14 days after the notification.

Delivery

Goods are shipped to the following countries: Estonia, Latvia, Lithuania, Finland

To receive the goods, the buyer has the following options: list here the Online Store's parcel machine partners, courier companies, or the option to pick up the goods themselves.

The buyer bears the shipping costs, and the corresponding price information is displayed next to the delivery method.

Domestic shipments generally reach the destination specified by the buyer within 3 working days from the conclusion of the sales contract. Delivery outside Estonia takes place within 7 calendar days.

In exceptional cases, the right is reserved to deliver the goods within up to 45 calendar days.

Right of Withdrawal

After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.

NB! Depending on the products, the buyer may not have the right to withdraw, and such products and services should be listed and must comply with the conditions listed in § 53 (4) of the Law of Obligations Act.

The right of withdrawal does not apply if the buyer is a legal entity.

To use the 14-day right of return, the ordered goods may not be used in any other way than is necessary to ascertain the nature, characteristics, and functioning of the goods in the same way that it would be allowed to test the goods in a physical store.

If the goods have been used for purposes other than necessary to ascertain the nature, characteristics, and functioning of the goods, or show signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.

To return the goods, a withdrawal statement must be submitted, the form of which can be found here: link to the withdrawal statement, and sent to the email address info@peachyswear.com no later than 14 days after receiving the goods.

It is a good practice to offer your customers free returns, which increases reliability and thus sales. Therefore, the following paragraph is for merchants who cannot offer free returns.

The costs of returning the goods are borne by the buyer, except in cases where the reason for the return is that the product to be returned does not correspond to the ordered one (e.g., wrong or defective product).

The buyer must return the goods within 14 days of submitting the withdrawal statement or provide proof that they have handed over the goods to the carrier within this period.

Upon receipt of the returned goods, the Online Store will immediately, but no later than 14 days after receiving the withdrawal statement, refund all payments received from the buyer under the contract.

The Online Store may refuse to make refunds until the item that is the object of the contract has been returned or until the buyer has provided proof that the item has been sent back, whichever occurs first.

If the buyer has explicitly chosen a delivery method different from the least expensive standard delivery method offered by the Online Store, the Online Store does not have to refund the cost that exceeds the cost associated with the standard delivery method.

The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the Online Store was significantly lower than the market price due to an error.

Right to File a Complaint

The Online Store is responsible for the non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and that occurs within two years from the delivery of the goods to the buyer. Within the first year from the delivery of the item to the buyer, it is presumed that the defect was present at the time of delivery. It is the responsibility of the Online Store to refute this presumption.

The buyer has the right to contact the Online Store within two months of discovering a defect by sending an email to info@peachyswear.com.

The Online Store is not responsible for defects that occur after the delivery of the goods to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online Store will refund the buyer all fees associated with the sales contract.

The Online Store will respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.

Direct Marketing and Processing of Personal Data

The Online Store uses the personal data entered by the buyer only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to companies providing delivery services to deliver the goods.

The Online Store sends newsletters and offers to the buyer's email address only if the buyer has expressed a wish to receive such direct marketing messages by entering their email address on the website and indicating their desire to receive direct mail notifications.

The buyer can unsubscribe from offers and newsletters sent to their email at any time by notifying us via email or by following the instructions provided in the email containing the offers.

Dispute Resolution

If the buyer has any complaints regarding the Online Store, they should be sent to the email address info@peachyswear.com.

If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer can contact the Consumer Disputes Committee. The conditions of the procedure and the application can be found here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. Reviewing the buyer's complaint by the committee is free of charge.
